Sharia Judge Michael J. Callahan Nullifies the Fourth Amendment Rights of Christians in Michigan

Michigan's war against the Constitutional rights of Christians has reached its peak.

In every state in this country, with one exception, a police officer cannot seize a person or her property without probable cause (a reasonable belief that a person has committed a crime).

Today, Judge Michael J. Callahan ruled that the Fourth Amendment of the U.S. Constitution does not apply to Christians in the state of Michigan. If a Christian visits Michigan, she may be detained, seized, arrested, and thrown in jail based on no evidence whatsoever.

At last year's Arab Festival in Dearborn, Corporal Brian Kapanowski approached Negeen Mayel and ordered her to turn off her video camera. Since Negeen hadn't been accused of committing any crime, she was under no legal obligation to obey his order (and, let's face it, he was only ordering her to stop filming so she wouldn't catch our unlawful arrests on tape). When Negeen didn't immediately turn off her camera, and instead asked why she was being questioned, Corporal Kapanowski grabbed her, seized her camera (which police then kept for more than three weeks), dragged her out of the tent, arrested her, threw her in jail, and charged her with two crimes.

Obviously, in any court that honors the Constitutional rights of citizens, Kapanowski would be in trouble. It turns out, however, that Dearborn courts have as much contempt for the Constitution as Dearborn police. Before the trial even began, Dearborn Judge Mark Somers ruled that Corporal Kapanowski had probable cause to arrest Negeen, even though she hadn't been accused of any criminal activity.

Do not miss the implications of this ruling. According to Judge Somers, in the City of Dearborn, police have probable cause to arrest Christians, even if the Christians haven't been accused of a crime. This means that any Dearborn police officer may arrest any Christian, simply because he feels like it.

Since we realized we weren't going to get justice in Dearborn, we were hopeful that the appeals court would have more respect for our fundamental rights as American citizens. Our hopes were dashed today when Judge Callahan ruled that police may indeed arrest a Christian who hasn't been accused of a crime.

Amazingly, people act like we're crazy when we say that Dearborn is being influenced by Sharia. But the facts speak for themselves. Christians are rapidly becoming second-class citizens in Michigan, and anyone who speaks up is quickly labeled an "Islamophobe." The saddest part of this is that non-Muslims are the ones who are doing the difficult work of destroying the Constitution. Mayor John O'Reilly, City Prosecutors William "Sharia Bill" DeBiasi and Debra Walling, Corporal Kapanowski, Sergeant Mrowka, Chief Haddad, Judge Somers, and now Judge Callahan are all trying desperately to undermine the U.S. Constitution.

And practically no one seems to care.

Many Dearborn residents are offended when people say that Sharia is taking hold in their city. But until the City of Dearborn starts showing some degree of respect for the rights of non-Muslims, until Christians are free to discuss their faith without being arrested, until the Fourth Amendment actually protects teenage girls from illegal search and seizure, the accusations are going to continue.

(NOTE: I have referred to the "Constitutional rights of Christians." Since certain readers love to misrepresent and distort what I say, let me go ahead and state clearly that I do not believe, never have believed, and never will believe that only Christians should have Constitutional rights. All U.S. citizens, regardless of race or religion, are protected by the Constitution. Indeed, I would be just as opposed to police violating the civil rights of a Muslim or an atheist as I would a Christian. But in this case, it's the rights of Christians that are being violated, so that's the topic of the post.)

So what does this mean, you've lost your appeal? Is it over? Negeen has not had her record expunged? For saying "no, don't touch me"? I can't believe it.

Does this have any bearing on your lawsuit? I'm afraid I have very little knowledge of the American judicial process, but the law seems to be as much of an ass as it so often is in the UK.

This is a travesty of justice. But it is only the first step in a long process. I hope that the lawyers have the fortitude and money to continue the fight and take this to the next level, as well as the strength for Negeen to continue on with the fight.

I believe that if Muslims want to be governed by Sharia law they should be, but before they can they must sign a binding waver that they will give up all constitutional protections.

Ask any Muslim living in the USA if they are willing to give up the any of the kuffar, man made constitutional protections afforded to them in the Bill of Rights.

See they live under the delusional that Allah's laws are better then the Constitution, but they want to run to the constitution for protection against Allah's law's.

This might be the end of the road for this case. We don't have the right to demand an appeal. We can request an appeal (and we will), but the request may be denied.

If I get rich sometime soon, I'm going to get a production crew and make a documentary titled "Welcome to Dearborn: Sharia in the U.S." Then I'm going to send a copy to every person in the country.

Is Negeen going to be okay?

I have always thought that those video cameras in phones could protect you from something like this, but what if the police was getting ready to brutalize a citizen, and he ordered witnesses to put their phones down?

This is just scary for me as an American in so many ways.

That's why she didn't want to turn the camera off. She was a good distance from the rest of us (who had no clue that anything was happening), and six people surrounded her. She wanted to leave the camera on for her protection (which is perfectly legal).

Keep things in perspective. This is just one skirmish in a long war. You guys fought brilliantly. And it ain't over. At most, you might have to adjust your tactics and strategy somewhat. That's all. Thank you for the great work you all did, which was immensely educational and extremely brave. Setbacks like this are nothing. Don't make them into something. Except opportunities to learn and to teach what you learn.

But presumably you are still going forth with the civil lawsuit. And since Negeen's case is clearly connected to the larger issue that will be brought up in the civil lawsuit, it would seem (just on the basis of common sense - I don't know about the details of the US law) that you might have a better shot at correct the wrong that has been done to Negeen after you (hopefully) have won your civil lawsuit.

I am sure it is possible to spread the facts without you suddenly receiving a fortune. Is there no possibility in the US to connect with a group of influential people and really effect the media? Do Christians in the US not engage in lobbying much like Muslims and atheists?

Negeen {{{Hugs}}} i'm so sorry!! I can't imagine... I thought for sure they would overturn that dumb ruling. I guess this world is going downhill very very fast & will only get worse until Jesus comes! I don't know why this is happening, all I can think of is that God knows too. The same thing happened when Jesus was here, the people & rulers had Him crucified without a good reason too. You've stood up and were a good witness for Jesus Negeen. I'm proud of you! Hopefully this will make people realize that time is running out- Jesus really is coming soon! *Smile* I can't wait, but have a feeling that this is just the beginning. God Bless You!

It seems like we are coming to another chapter in our country's history where civil disobedience is the only course of action. Sadly though you need not only look at Dearborn for American citizens to have their rights denied because of their faith, the public school system has been waging that war for over 40 years!!!!!! Be strong and of courage!!!

I am doing okay. I am no doubt disappointed by the outcome, it is a huge travesty of justice and I hate having a criminal record for something I don't deserve. I am talking to my Lawyer about what the next steps are and we will fight this thing as much as we can. We are not guaranteed justice in this life, only in the one to come. The sentence is still the same (time served) which means that I already served my time in jail. As for now I'm in college full time and I work full time and I am determined not to let this gross injustice hamper my joy and harden my heart. My Lord is still Lord and he will ultimately be the one who passes perfect judgement.

If I were you guys, I'd take this all the way to the supreme court. I am really finding this story hard to believe though. A judge does not have the right to rule against the constitution, or does he? I don't know. I am really finding this hard to comprehend.

I think that the Federal Court of Appeals should hear this case.
If necessary, it should be taken all the way up to the Supreme Court.
And as for Michigan, I have made a knotted one-decade rosary and I will gladly pin it to any outerwear jacket I wear there.
Christianity stands for the redemption of the captive and the right to dignity of the weak, the unrecognized and the scorned.
Islam loves only the strong, the victor, the recognized.
It is truly an exponent of injustice.

And if the situation were reversed, and it was Muslims passing out literature at a Christian festival, do you think anything would have been said, even if people complained about it? Nope, not a chance. Most governmental agencies and private organizations have an unwritten "do not oppose" policy concerning the Islamics and their activities, in case you hadn't noticed!!

David, can you explain a little more about why you cannot demand a further appeal? Is it because it's a Michigan court? Can it not even be appealed to the Michigan Supreme court?

Wow, I'm googling Judge Callahan, and he looks like kind of a liberal rogue.

I suppose his ruling and the problems with appealing the conviction make it all the more important that an active suit is being brought in federal court. But Michigan's state supreme court has also been pretty good, so I think it would be good if this could be appealed there.

Since there's been a fourth amendment violation, it would seem that this _should_ be able to bring the appeal into federal court as well, but I could just be completely wrong about this.

Next year I suggest you invest in "pen camera's", they look like a pen, fit nicely into your pocket, have a pinhole camera (good quality video from what I am told, good sound too), if not that then a nice wifi glasses mounted camera, have someone hidden away in a van recording the whole thing. then if you are arrested it can be posted immediatly. gotta go covert if you are going to uncover and expose the truth. besides they are much cheaper than video cameras and must harder to detect by the thugs in hire to islam.

Nice try. That's called a "Straw Man." (It's where you misrepresent your opponent's claim, then attack your misrepresentation, rather than the opponent's actual position.) You're representing our position as "All of Dearborn is officially under Sharia Law." To refute this claim, you'd simply need to show a woman without a hijab on. Unfortunately for you, we've never made that claim. In fact, instead of responding to your comment, I'll go ahead and paste what we've already said on this issue. As you can see, we've clearly (and repeatedly) stated our position, which makes me wonder why people continue to misrepresent it. You can find this in the "Dearborn" tab. Here goes:

We've clarified our position over and over again, but let me go ahead and quote another passage from a previous post.

"QUESTION: How can you say that police are implementing Sharia law when most of them are not Muslims?

ANSWER: If they’re taking away the rights of Christians in order to satisfy Muslims, then they’re implementing Sharia law, according to which Christians are not free to preach to Muslims."

So our actual position is that, regardless of their intentions, Dearborn police are enforcing an element of Sharia. Suppose, for instance, that a police officer chops off his hand in order to make a local imam happy. I would say that such a police officer enforced Sharia. Similarly, if police stop Christians from evangelizing, etc., they're enforcing Sharia.

BTW, your arguments sound familiar. Are you sure you're not an infamous someone who was previously banned from this blog (under a new name, of course)?

In fact, those who would Islamize the country are counting on this all or nothing perspective. If we understand the nuances, and the shades of Islamic tradition being brought into American culture, society and law, then it will force advocates of Islamization and Sharia right out into the open.
Then it is they who will be forced to make black and white statements.
